These Booking Terms and Conditions (Terms) constitute the agreement between Holistic Living Training Institute (HLTI) (ABN 33418339302), its successors, and assignees (referred to as "we," "us," or "our") and you, the organisation, entity, or individual purchasing Services from us (referred to as "you" or "your"), collectively referred to as the Parties. These Terms apply to all purchases made by you from us.

You acknowledge that these Terms form the agreement under which we will provide Services to you. It is essential that you carefully review these Terms and reach out to us with any inquiries using the contact information provided on our website. You signify your agreement to these Terms by:
a) Utilising or acquiring our Services, including indicating acceptance online when completing our order form or placing an order for our Services via email or phone to reserve your Retreat/Course.
b) Confirming your acceptance of these Terms via email.
c) Instructing us to proceed with the Services.
d) Making any payment for the Services and any Booking outlined in our invoice/request for payment to you.
By signifying agreement to these terms in one of the above ways you acknowledge that you have reviewed and agreed to the terms and are encouraged to seek clarification if needed. You affirm your acceptance and commitment to abide by these Terms, confirming that you are 18 years of age or older. If you are under 18 years of age you are prohibited from submitting a Booking Form or otherwise requesting the Services. If you do not agree to these Terms, you are not permitted to utilise or procure our Services from us, or engage in any of the aforementioned actions.
1. Booking Policy
1.1. All reservations are contingent upon availability. Reservations for our overnight retreats are only confirmed upon receipt of a non-refundable deposit of $250 for weekend retreats, $500 for other domestic retreats, or $1000 for international retreats. Some retreats may necessitate a lower or higher deposit, or full payment at the time of booking, which will be communicated to you during the booking process.
1.2. For overnight retreats, the remaining balance is due 60 days prior to the retreat start date, for international retreats and depending on any other specific retreat. If you book within 60 days of the retreat start date, full payment is required at the time of booking depending on the retreat type. These conditions apply unless otherwise stated on a call or in an email confirmation from a HLTI representative during registration.
1.3. Participants who have registered for retreats requiring international travel must acquire comprehensive travel insurance or possess medical insurance covering various expenses, including overseas medical costs, evacuation fees, trip cancellations, and force majeure occurrences.
1.4. It is strongly recommended to obtain travel insurance for overnight retreats in Australia, and mandatory for international retreats.
1.5. Participants must be at least 18 years old to attend group Retreats/Day Events (in person) and online Courses/Events unless the Holistic Living Training Institute has stipulated in writing the retreat or online course/event is suitable for participants aged under 18.
1.6. By submitting your deposit or full payment for a Retreat/Day Event or online Course/Event, you agree to abide by our Booking Terms and Conditions.
1.7. To facilitate your Retreat/Day Event (in person) or online Course/Event booking and service provision, we may need to share your personal information with third parties responsible for organising various aspects of your Retreat/Course/Event. Any use or disclosure of your personal data by us complies with the Privacy Act 1988, the Privacy Legislation Amendment (Enforcement and Other Measures) Act 2022 and the Australian Privacy Principles. Our Privacy Policy is available on our website.
1.8. When using credit towards a Holistic Living Retreat/Day Event (in person) or online Course/Event, please note that the credit amount will be deducted from the full price, not the early bird pricing.
1.9. COVID-19 Policy: Refunds related to COVID-19 for our overnight retreats, day events, or online courses (due to lockdowns, close contact isolation, contracting COVID-19, or a family member contracting the virus) are subject to the discretion of the Holistic Living Training Institute. We are not liable for expenses incurred in preparing for any cancelled retreat/day event, such as airfare, accommodations, travel insurance, airport transfers, illness, loss of work, etc.
2. Payment Policy for Group Holistic Living Retreats and online Courses/Events
2.1a. Payment in full must be received at least 60 days before the Retreat/Day Event (in person) starts, depending on the event type booked. Details will be provided at the time of booking. If you reserve within 60 days of the retreat starting, full payment is required to secure your spot. Unless otherwise specified in writing during the registration process, failure to pay the full amount within this timeframe results in forfeiture of the deposit. We reserve the right to resell your place in the retreat if full payment is not received 60 days before the retreat begins.
2.1b. Full payment must be received within 3 days of booking or at the time of booking online for all Day Events. Failure to do so may result in the loss of your spot at the day event.
2.2. You are responsible for any bank fees, credit card charges, Stripe, or Paypal fees incurred during money transfers.
2.3. Any services not included in the Retreat package are the responsibility of the participant and must be paid for in the local currency of the retreat destination.
2.4. While most fees are stated in Australian dollars, some products and arrangements may be in foreign currency and subject to applicable exchange rates. Payments made to the retreat venue or hotel upon check-out, such as room costs, venue wellness programs, or incidentals, are in the local currency of the venue. Additional fees and charges, including cross-border, exchange, or currency conversion fees, may apply depending on your payment method, bank, card issuer, or financial institution processing the transaction. We are not responsible for these fees and charges or for fluctuations in the value of your purchase in Australian currency due to changes in exchange rates.
2.5. If payment is made by credit card, you confirm that the provided information is accurate and complete, that you are authorised to use the credit card for payment, and that your payment will be honoured by your card issuer. We may conduct checks to verify your identity and payment details, which may involve requesting additional information from you.
2.6. The Holistic Living Training Institute is not liable for cancellations made by third-party venues. If a venue cancels our booking, we will refund only the cost of the ticket held with the Holistic Living Training Institute. We will not refund any travel-related expenses such as airline or train tickets or costs incurred from other transport providers. Additionally, we will not refund any accommodation costs for dates directly before or after our booked retreat.
3. Cancellation Policy
3. Cancellation Policy:
3.1. All requests for cancellations must be submitted in writing to holisticlivingtraining@gmail.com. It is your responsibility to confirm receipt of your message to us by contacting the Holistic Living Training Institute to avoid potential additional cancellation fees resulting from delayed communication. The Holistic Living Training Institute will not be held accountable for any costs incurred due to messages not being received or delayed notification of cancellation. You must ensure that flights, travel insurance, and any other components booked outside of the retreat are cancelled, adhering to the cancellation policies of each individual supplier. Requests to transfer the booking to another Retreat Participant must be made in writing to holisticlivingtraining@gmail.com and are subject to approval.
3.2a. Cancellation fees for all Australian domestic and international Holistic Living Training Institute retreats are outlined as follows:
Cancellations made:
60 or more days before the booked retreat date: The non-refundable deposit will be forfeited. If full payment has been made, the remainder minus the non-refundable deposit can be transferred to a future retreat, valid for 18 months from the booking date, or a refund can be requested minus the deposit balance.
Between 0 and 59 days before the retreat start date: No refund or transfer is permitted, resulting in forfeiture of 100% of the retreat fees paid, including the deposit.
COVID-19: Refunds will not be issued if an inability to attend the retreat is due to being required to isolate as a close contact of a COVID-19 case or contracting Covid-19 oneself. It is strongly advised to purchase travel insurance to cover Covid-19 related cancellations or delays.
Retreat prices include credit card fees. Refunds, if applicable, are at the discretion of the Holistic Living Training Institute. Credit card fees and payment processing fees from our automated booking system will not be refunded.
Travel insurance is mandatory for attending overseas retreats and recommended for Australian domestic retreats.
3.2.b. Cancellation fees for our Holistic Living Day events in Victoria are detailed as follows:
Cancellations received:
60 or more days before the scheduled event date: You have the option to transfer 100% of your payment to a future event or request a full refund.
Between 0 and 59 days before a scheduled Event (in person or online) start date: No refund or transfer is permitted, resulting in forfeiture of 100% of the fees paid, including any deposit made. Any refunds are subject to the discretion of the Holistic Living Training Institute.
COVID-19: Refunds will not be provided if inability to attend the event is due to being required to isolate as a close contact of a Covid-19 case or contracting Covid-19 oneself.
Event prices include credit card fees. Refunds, if applicable, are at the discretion of the Holistic Living Training Institute. Credit card fees and payment processing fees from our automated booking system will not be refunded.
3.3. In adherence to our commitments with accommodation providers, instructors, tour operators, and transport companies, we are unable to waive the aforementioned cancellation fees for retreats or local events, even in cases of illness. We do not provide credit for late arrivals, early departures, missed activities, or unused parts of the scheduled program. Refunds, if granted, are solely at the discretion of the Holistic Living Training Institute. We strongly advise purchasing travel insurance for domestic retreats. Travel insurance is mandatory for overseas retreats.
3.4. For international retreats, proof of travel insurance must be submitted at least 60 days before the retreat starts. If booking within 60 days of the retreat, documents must be provided within one week of booking. Failure to do so may result in automatic cancellation, subject to the cancellation policy mentioned above.
3.5. In the event that the Holistic Living Training Institute cancels or alters a scheduled Retreat or day Event (in person), excluding force majeure circumstances (see clause 3.7), you have the option to transfer your payment to another event within an 18-month period, subject to availability, or request a full refund to your original payment method.
3.6. We are not liable for any expenses incurred due to the preparation of a cancelled retreat or day event, including but not limited to airfare, accommodation, insurance, transfers, illness, or loss of work.
3.7. We will not be held accountable for cancellations or delays in fulfilling our obligations under this agreement due to force majeure events or conditions deemed too dangerous for participants.
3.8. In case of a cancellation or refund, we are not responsible for currency fluctuations and will refund the original amount as stated on the invoice.
3.9. Any changes to your itinerary or schedule after we issue your Booking Confirmation, such as name changes or cancellation requests, may result in additional fees and charges according to Third Party Terms.
4. Prices and Schedules/Itineraries
4.1. Prices and schedules/itineraries displayed on the website are subject to change. We reserve the right to modify Retreat/Day Event (in person) or online Course/Event prices, as well as prices for individual add-on components, without prior notice. Existing bookings with full payment or deposits will maintain their original price as per the invoice.
4.2. We retain the right to alter the original program or schedule of a Retreat/Day Event (in person) or online Course/Event booking due to extraordinary circumstances (e.g., external forces, governmental regulations, third-party delays, weather conditions, etc.). Schedules and itineraries, including activities and workshops, are subject to change without notice.
4.3. We reserve the right to change the location of a Retreat/Day Event (in person) due to unforeseen issues (e.g., third-party delays, construction, etc.), while ensuring the standard is consistent across all partnering venues.
4.4. Prices of venues or individual services provided by third parties, and any components therein, may change at the discretion of the supplier. The fees displayed for an itinerary will be current at the time of booking.
5. Liability
5.1. To the maximum extent permissible by law, neither the Holistic Living Training Institute nor any of its directors, partners, employees, or contractors assume liability for any injury, damage, loss (including consequential loss), delay, additional expense, or inconvenience directly or indirectly caused by the acts, omissions, or defaults, whether negligent or otherwise, of third-party providers over whom we have no direct control and which cannot be prevented by reasonable diligence on our part. As the retreat operator, we make arrangements with other parties to provide certain services during your retreat e.g. catering. These parties are independent suppliers over whom we have no direct control. The Holistic Living Training Institute bears no responsibility for changes made by independent contractors (or weather conditions) affecting services during the retreat.
The Holistic Living Training Institute is not liable for any claims, losses, damages, costs, or expenses arising from injury, accidents, deaths, property damage or loss, delays, inconvenience, loss of enjoyment, or frustration, whether physical or mental, resulting from various factors including, but not limited to: (1) actions or omissions of any party including the Holistic Living Training Institute or its employees; (2) mechanical breakdowns, government actions, weather, or other factors beyond our control; (3) failure to read provided information and follow instructions, including obtaining sufficient travel protection and health insurance and providing accurate personal, health, and travel information; (4) cancellation or changes for any reason in offered travel services; and (5) medical or health issues or physical disabilities.
5.2. By participating in any Retreat/Day Event (in person) and activities, courses, and excursions arranged by us, retreat venues, organisers, or third-party hosts, you acknowledge your voluntary participation and, to the extent legally permissible, waive the right to hold any organisers responsible for any loss or damage to person or property occurring during our retreats.
5.3. The Holistic Living Training Institute reserves the right to modify this policy at any time. The current policy always applies.
5.4. It is your responsibility to review the details in your Booking Confirmation, including your full name(s), Retreat/Day Event (in person) or online Course/Event booking dates, and location, before confirming and providing payment.
5.5. We arrange and book your Retreat/Day Event (in person) and our services are subject to Third Party Terms. By agreeing to these Terms, you authorise us as your agent to make bookings on your behalf and arrange contracts between you and each third-party service provider. Any Retreat/Day Event (in person) or online Course/Event booked by you is subject to Third Party Terms, and your legal rights regarding any aspect of the Retreat/Day Event (in person) or online Course/Event booking are between you and the party identified in the Third Party Terms and the Australian Consumer Law.
5.6. Third parties who are not our employees or direct contractors, including but not limited to suppliers of services offered under an in-person Retreat/Day Event, are your responsibility. Such third parties reserve the right to cancel or reschedule your booking due to unforeseen circumstances. To the fullest extent permitted by law, we are not responsible for the services provided, or any change or cancellation, by those third parties.
5.7. Participants must inform the Holistic Living Training Institute of any dietary restrictions and allergies at the time of booking. Please note: as we collaborate with several retreat venues, we may not be able to accommodate all dietary restrictions. Please verify with us before making full payment, and we will check with the venue on your behalf.
5.8. By submitting a booking request and confirming your booking, you automatically agree to our Liability Waiver: In consideration of the services provided by the Holistic Living Training Institute, their agents, owners, officers, volunteers, participants, employees, service suppliers, and all other persons or entities acting on their behalf, you hereby release, indemnify, and discharge the Holistic Living Training Institute from all claims, losses, damages, costs, and expenses resulting from your participation in activities during your retreat/day event. This includes known and unanticipated risks such as injury, death, or damage to person or property. You agree to assume all risks associated with participation, including any medical or physical conditions you may have, and to bear the costs of any resulting injury or damage. You further agree to indemnify the Holistic Living Training Institute against any legal claims and expenses incurred to enforce this agreement. You acknowledge that this agreement releases the Holistic Living Training Institute from any liability for injuries or damages that may occur during your participation in the Retreat/Day Event (in person) or online Course/Event.
5.8.1. You recognise that engaging in holistic living practices such as breathwork, movement, meditations and travel carries both known and unforeseeable risks that could lead to physical or emotional injury, paralysis, death, or property damage to yourself or others. You understand that these risks are inherent to the activity and cannot be entirely eliminated without compromising its essential nature. Your participation in all activities during your Retreat/Day Event (in person) or online Course/Event is entirely voluntary, and you explicitly agree to accept the risk of injury or damage without entitlement to a refund or discount. Additionally, you understand that while Holistic Living Training Institute facilitators and coaches prioritise safety, they are not infallible. They may be unaware of participants' physical fitness levels or abilities, misjudge environmental factors, or encounter equipment malfunctions, despite their best efforts to mitigate risks.
5.8.2. You acknowledge that your participation in any and all activities, risks, and use of accommodations during in person Retreat/Day Event is entirely voluntary, and you assume all associated risks of injury, illness, damage, or loss to yourself and your property. You expressly agree to accept and assume all risks inherent in the holistic living practices presented, understanding that these risks may include, but are not limited to, sprains, strains, broken bones, paralysis, and even death, as well as exhaustion.
5.8.3. You confirm that you possess adequate travel protection insurance to cover any potential need for cancellation or alteration of your travel plans. Furthermore, you certify that you have sufficient health insurance to cover any injury or damage you may cause or sustain during participation in any activities, otherwise agreeing to bear the costs personally. Additionally, you accept responsibility for any medical or physical conditions you may have, assuming the associated risks.
5.8.4. You voluntarily release, discharge, and agree to indemnify and hold harmless the Holistic Living Training Institute, its facilitators, coaches, managers, and suppliers against any claims, losses, causes of action, damages, or expenses, including legal fees, arising from such claims, regardless of their validity, including claims alleging negligent acts or omissions by the Institute.
5.8.5. In the event that the Holistic Living Training Institute or its representatives incur attorney's fees and costs to enforce this agreement, you agree to indemnify and hold them harmless for such fees and costs, and you agree not to pursue legal action in any jurisdiction.
5.8.6. You accept responsibility for any damage that may occur by you at the venue during your stay and acknowledge that you may be billed accordingly by the venue.
5.8.7. You acknowledge that in the event of injury to anyone or damage to property during your participation in the retreat/day event, you may be deemed to have waived your right to pursue legal action against the Holistic Living Training Institute. By registering for this event you agree to these terms and conditions and in doing so agree to release the Institute, its facilitators, coaches, managers, and suppliers from any responsibility for loss, mishap, accident, injury, or death that may occur during your participation in the Institute's activities.
5.8.8. Prior to checking out of the venue, you are accountable for settling any incidentals (such as additional services, drinks or items consumed ) that are not included in the retreat package.
5.8.9. By acknowledging this, you understand that the Holistic Living Training Institute may use retreat photographs and images featuring you solely for the company's marketing purposes.
6. Passport, COVID-19, and VISA information for International Retreats
6.1. Passport validity requirements vary across countries, with many governments stipulating a minimum validity of six months beyond the intended stay period. Additionally, passports must have at least four blank pages to be considered valid for travel.
6.2. When travelling or transiting through a country, it is your responsibility to ensure that you possess valid passports, visas, visa waivers, and re-entry permits that comply with the requirements of local immigration and government authorities.
6.3. You are responsible for being informed about COVID-19 testing, entry requirements, and travel regulations. Any costs associated with COVID-19 testing, both current and future, are your responsibility. Any expenses related to COVID-19, including cancellations, incidents, medical bills, delays, or other costs, are also your responsibility.
7. Health Abroad
7.1. The Holistic Living Training Institute is based in Australia and therefore is guided by the Australian Government. The Australian Government advises scheduling a basic health check-up with your doctor or travel clinic to address health requirements, such as vaccinations, and precautions specific to your destinations. If travelling from a country other than Australia it is your responsibility to check your country's health advice. In addition to health risks, certain countries may prohibit travel unless you can provide proof of immunisation. The World Health Organization offers health guidance for international travellers.
7.2. Before travelling with medication, it is essential to confirm its legality in the destination country. Sometimes, you may need a doctor's letter detailing your medical condition and a comprehensive list of required medications. Typically, medications should be carried in their original packaging, clearly labelled. For further medical advice, consult your local physician.
7.3. Some countries mandate tourists to carry proof of medical coverage, usually in the form of travel insurance, for entry. It is advisable to always have a copy of your policy with you while travelling.
7.4. Ensuring you have all necessary vaccinations for COVID-19 is your responsibility. Any expenses incurred due to denial of entry to a country or state in Australia are your responsibility.
8. Complaints
8.1. Should you encounter any issues during your Retreat/Day Trip/Event, or wish to provide feedback, kindly notify the retreat leader immediately, who will make efforts to address your concerns. Please be aware that we cannot be held accountable for the individual conduct of any group member or guest sharing your room/accommodation.
8.2. In the event of a dispute between the Parties concerning these Terms, the Parties consent to the following dispute resolution procedure: a) The complainant must communicate in writing to the respondent the nature of the dispute, desired outcome, and proposed actions for resolution. b) If the Parties are unable to reach an agreement on resolving the dispute, either Party may seek mediation. If agreement on a mediator cannot be reached, the complainant will request the Law Society of Victoria to appoint a mediator. The mediator will determine the time and location for mediation, which the Parties must attend in good faith to seek resolution.
8.3. Any efforts by the Parties to resolve a dispute under this clause do not prejudice other rights or entitlements of the Parties under these Terms, by law, or in equity.
9. Responsibilities
9.1. Throughout the duration of these Terms, you assure that: a) There are no legal impediments preventing your acceptance of these Terms; b) You will collaborate with us and furnish us with information reasonably essential to facilitate the provision of Services as requested by us periodically, and comply with such requests promptly. This information may encompass, but is not limited to, your personal details, contact information, payment particulars, passport data, and those of any co-host; c) The information you furnish us is accurate, truthful, and comprehensive; d) You will not violate any third-party rights while engaging with us and availing of the Services; e) You will promptly notify us of any reasonable concerns regarding our delivery of Services under these Terms, with the intention that both parties will exert reasonable efforts to resolve such concerns
10. Our intellectual property
10.1. The Retreat/Event/Course Materials contain content owned by or licensed to us, protected by both Australian and international laws. We either own or possess the appropriate licence for the Intellectual Property rights within the Materials, including but not limited to the copyright existing in all creative and literary works integrated into our Materials.
10.2. You acknowledge that, in the relationship between you and us, we retain all Intellectual Property rights in our Materials. Nothing in these Terms constitutes a transfer of any Intellectual Property rights in our Materials, except as explicitly stated herein or with our written consent.
10.3. Your utilisation of our Materials does not confer upon you a licence or right to utilise any Intellectual Property within the Materials, whether registered or unregistered, except as expressly outlined in these Terms or with our written consent.
10.4. You are prohibited from violating our Intellectual Property rights by, among other things: a) Altering or modifying any of the Materials; b) Creating derivative works from the Materials; or c) Using our Materials for commercial purposes, such as resale to third parties.
10.5. This provision remains effective even after the termination of these Terms.
11. Your intellectual property and moral rights
11.1. When you provide information, including any Intellectual Property, to us, you: a) Confirm that you possess all necessary rights to provide the Intellectual Property; b) Grant us a perpetual, non-exclusive, royalty-free, irrevocable, worldwide, and transferable licence to utilise the Intellectual Property as needed to deliver the Services to you; and c) Consent to any action or omission that would otherwise infringe upon your Moral Rights.
11.2. If you (or any employee or agent) hold Moral Rights in any Intellectual Property you provide to us, you: a) Irrevocably agree to any modification of the Intellectual Property by us; b) Irrevocably agree to us using or applying the Intellectual Property without attributing authorship; c) Acknowledge that your consent extends to actions and omissions by any of our licencees and successors in title; and d) Confirm that your consent is genuine under the Copyright Act 1968 (Cth) and has not been coerced or induced by any false or misleading statement.
11.3. This provision remains effective even after the termination of these Terms.
12. Termination
12.1 . Either party has the right to terminate these Terms in the event of a material breach, subject to following the dispute resolution procedure.
12.2. We reserve the right to immediately terminate these Terms at our discretion if: a) We deem a service request inappropriate, improper, or unlawful; b) You fail to provide clear or timely instructions and/or requested information for us to deliver the services; c) Our working relationship deteriorates, leading to a loss of confidence and trust; d) Your actions reasonably risk tarnishing our reputation or that of our site; e) Incorrect payment details or other inaccurate information are provided; f) An invoice remains unpaid 14 days after a written demand for payment; g) Any external factors beyond our control compromise our ability to deliver services within the required timeframe.
12.3. Upon termination of these Terms, you acknowledge that any deposits and certain payments made are non-refundable, and you are responsible for payment of all services provided prior to termination, including those already performed but not yet invoiced.
12.4. Upon completion of the services, we will retain your documents (including copies) as mandated by law or regulatory requirements. Your agreement to these Terms, whether express or implied, authorises us to retain or destroy documents in accordance with statutory periods or upon termination of these Terms.
12.5. The termination of these Terms does not affect the accrued rights, obligations, or remedies of the parties.
13. Consumer Law, Limitation of Liability, and Disclaimers
13.1. Australian Consumer Law (ACL): If you meet the criteria of a consumer as defined in the Australian Consumer Law under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (ACL), the following provisions apply to you: You have the right to a replacement or refund for a major failure and compensation for any other foreseeable loss or damage. You're also entitled to have services rectified if they're not performed with due care and skill or if they're unfit for their intended purpose, provided the failure does not constitute a major one. We aim to limit our liability; therefore, our total liability for any loss or damage you suffer or incur from our services is restricted to either re-supplying the services to you or refunding you the amount paid for the relevant services, at our discretion.
13.2. Refunds: Your entitlement to a refund for any fees paid is subject to your rights under the ACL or corresponding foreign laws, which may apply to any product purchased as part of a HLTI service, these Terms, and Third Party Terms. Some fees, as outlined in our Retreat information, are non-refundable in the event of a change of mind by you. We will inform you of any cancellation fees applicable to changes or cancellations for a Retreat in our Retreat information. Any applicable refunds will be processed using the same payment method used for fee payment. Please note that refunds from venues may not be immediate for us. While we will make reasonable efforts to assist you with any applicable refund, your rights and any refund payment are subject to the third-party provider and beyond our control.
